These Terms of Service ("Terms") govern your access to and use of the mobile applications, websites, and related services (collectively, the "Services") operated by Draxelx LLC ("Draxelx", "we", "us", or "our"). By using our Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old (or the minimum age in your country) to use the Services. By using the Services, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

2. Your Account

Most of our apps authenticate you anonymously through a device identifier. You are responsible for activity that occurs on your device. If an app offers email-based login, you are responsible for keeping your credentials secure and for all activity under your account.

3. Subscriptions and Payments

Some features require a paid subscription. Pricing is shown in-app before purchase.
Subscriptions are billed through the Apple App Store, Google Play, or our subscription processor, and are subject to their terms.
Auto-renewal — Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the period ends.
Cancellation — You can cancel anytime in your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period.
Refunds — Refunds are handled by Apple or Google according to their policies. We generally cannot issue refunds directly.

4. User-Generated Content

You retain ownership of content you submit to the Services (prompts, images, text, etc.). By submitting content, you grant Draxelx a worldwide, non-exclusive, royalty-free license to process, store, and transmit that content as needed to operate the Services and generate AI outputs you request.

You are solely responsible for your content. You agree not to submit content that:

Infringes intellectual property, privacy, or other rights of any party.
Is illegal, harmful, harassing, defamatory, or sexually explicit involving minors.
Contains malware, exploits, or attempts to interfere with the Services.
Impersonates another person or misrepresents your affiliation.

5. AI-Generated Output

Our Services use generative AI models from third-party providers. AI outputs are generated based on your inputs and may be inaccurate, incomplete, or unsuitable for your purpose. You should not rely on AI outputs for medical, legal, financial, or other professional advice.

Due to the nature of generative models, different users may receive similar or identical outputs from similar inputs. To the extent permitted by law and applicable provider terms, you may use AI outputs you generate for personal and commercial purposes, but you are responsible for ensuring such use complies with applicable laws.

6. Acceptable Use

You agree not to:

Reverse-engineer, decompile, or attempt to extract source code from the Services.
Use the Services to build a competing product or to train other AI models.
Bypass any usage limits, paywalls, or access controls.
Use automated tools, bots, or scrapers without our written permission.
Use the Services in any manner that violates applicable law.

7. Intellectual Property

The Services, including all software, designs, logos, and branding (excluding your content and AI outputs you generate), are owned by Draxelx LLC or its licensors and are protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal use, subject to these Terms.

8. Third-Party Services

The Services rely on third-party providers (AI models, hosting, payment processors, analytics). Their terms and privacy policies apply to your use of those services. We are not responsible for third-party services.

9. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or if we discontinue the Service. You may stop using the Services at any time. Provisions that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability) will survive.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI OUTPUTS. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRAXELX LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50.

12. Indemnification

You agree to indemnify and hold Draxelx LLC and its officers, employees, and affiliates harmless from any claims, damages, or expenses arising from your use of the Services, your content, or your violation of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Services after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles. Any dispute shall be resolved in the courts located in Wyoming, unless otherwise required by applicable consumer protection law.

15. Apple App Store Terms

If you accessed our app via the Apple App Store, you acknowledge that these Terms are between you and Draxelx LLC, not Apple. Apple is not responsible for the app or its content. Apple is a third-party beneficiary of these Terms and may enforce them against you.
